Tabule Theme Affiliate Program Terms
Version 1.0 — Effective August 01, 2026
These Affiliate Program Terms (the “Program Terms”) govern participation in the Tabule Theme Affiliate Program (the “Program”), operated by Ariel Sandoval, sole trader (OSVČ) registered in the Czech Republic under IČO 05831865, with registered address at Chudenická 1059/30, 10200, Prague 10, Czech Republic (“we”, “us”, “the Operator”).
By applying to the Program, you (“you”, “the Affiliate”) accept these Program Terms. Purchases made by referred customers are governed by the Tabule Theme Terms of Service and Privacy Policy. In case of conflict, these Program Terms govern the affiliate relationship; the Terms of Service govern product purchases and licensing.
1. Joining the Program
1.1 Application. Participation requires an application through our website and our express approval. We review every application manually and may accept or decline it at our discretion, with or without stated reasons.
1.2 Eligibility. You must be at least 18 years old and legally able to enter into this agreement. One affiliate account per person or legal entity. The Program is not available where participation would be unlawful.
1.3 Accurate information. You must provide, and keep updated, the information we request at registration, including your full legal name, address, country of tax residence, whether you act as a business or as an individual, your VAT ID / tax identification number where applicable, and a valid PayPal email address. Commission payments may be withheld while required information is missing, inaccurate, or outdated.
2. How Referrals Work
2.1 Referral link. Upon approval you receive a unique referral link. When a visitor clicks it, we set a tracking cookie in their browser valid for 60 days. Attribution is last-click: the most recent affiliate cookie at the time an order is placed earns the commission.
2.2 Qualifying Sale. A “Qualifying Sale” is a completed purchase of a Tabule Theme license placed while your referral cookie is active, which is not refunded or charged back, is not a purchase made by you or on your own behalf (Section 5.1), and does not otherwise violate these Program Terms.
2.3 Technical dependence. Tracking depends on the customer’s browser accepting cookies. We are not responsible for referrals lost because cookies are blocked, deleted, or expired, or because the customer used a different browser or device.
2.4 No coupon codes. No affiliate coupon or discount codes are available under the Program at this time. If we introduce them in the future, their use will be governed by these Program Terms and by the promotional rules in the Terms of Service (Section 4.3): promotions are never retroactive, one coupon per order, no stacking, and a license purchased with a promotional discount is a full license.
3. Commission
3.1 Rate. Your commission is 40% of the Net Sale Price of each Qualifying Sale.
3.2 Net Sale Price. “Net Sale Price” means the amount actually paid by the customer for the license, excluding any VAT, sales tax, or similar transaction taxes charged on the sale, and excluding payment processing fees charged to the customer, if any. The exact net amount for each sale is shown in your affiliate dashboard.
3.3 Founding rate; changes. The current rate is a founding-affiliate rate. We may change the commission rate, or any other Program parameter, for future sales with at least 30 days’ notice by email or dashboard notification. Changes are never retroactive: sales already made earn the rate in force at the time of the sale.
3.4 One-time commissions. Tabule Theme licenses are one-time purchases. Commissions are earned once per Qualifying Sale. License upgrades purchased later by a customer you referred are credited to you only if the upgrade order itself is a Qualifying Sale under Section 2.2.
4. Holds, Refunds, and Payouts
4.1 60-day hold. Each commission is held for 60 days from the date of the sale before becoming payable. This mirrors the refund windows that apply to purchases: our own 14-day money-back guarantee and refunds that our payment platform may issue for up to 60 days from purchase, as set out in the Terms of Service.
4.2 Reversals. If a sale is refunded (in full) or charged back, the corresponding commission is cancelled. If the commission has already been paid out, the amount will be deducted from your future balance or, if no sufficient balance accrues, must be repaid on request. Partial refunds are reviewed case by case.
4.3 Payout schedule. We pay commissions monthly, via PayPal, in USD, once your payable balance (commissions past the 60-day hold) reaches the minimum of $50. Balances below the minimum roll over to the following month. PayPal fees on outgoing payments are borne by us: you receive the full amount of your commission statement.
4.4 Payment record. Each payout is documented by a commission statement (Section 6) and the corresponding PayPal transaction record.
5. Promotion Rules
5.1 No self-referrals. You may not earn commissions on purchases made by yourself, your household, your own company, or otherwise on your own behalf, through your own link.
5.2 No brand bidding. You may not bid on “Tabule Theme”, “tabuletheme.com”, or confusingly similar terms (including misspellings) in paid search advertising, and you may not register domain names or social media handles containing our brand.
5.3 No coupon/deal sites and no incentivized traffic. You may not promote through coupon, discount-aggregator, or deal sites, and you may not offer cash-backs, rewards, or other incentives in exchange for purchases through your link.
5.4 Honest promotion. You must not present yourself as us, make false or misleading claims about the product, use spam (email, comments, messaging), or promote in contexts that are unlawful or damaging to the brand. You must disclose your affiliate relationship where the law of your audience’s jurisdiction requires it (e.g. FTC disclosure rules, EU consumer-protection rules).
5.5 Your channels. You are responsible for your own websites, channels, and their compliance with applicable law, including data-protection and marketing rules.
6. Invoicing (Self-Billing) and Taxes
6.1 Self-billing consent. You expressly agree that we issue the invoice/commission statement for your commissions on your behalf (self-billing) for each payout period. You will not issue your own invoice for these commissions unless we agree otherwise in writing. Each statement will identify the period, the attributed sales, the commission rate and amount, the currency, the date, and the tax details of both parties, including a reverse-charge note where applicable.
6.2 Objections. If you believe a statement is incorrect, you must object within 14 days of receiving it; otherwise it is deemed accepted.
6.3 Your tax data. You must inform us without undue delay of any change in your legal name, address, tax residence, business status, or VAT/tax identification numbers. Statements issued in reliance on the data you provided are deemed correctly issued.
6.4 Your taxes. You are solely responsible for declaring and paying any taxes, levies, or social contributions arising from your commissions in your own jurisdiction. Commissions are paid without deduction or withholding, based on your declaration under Section 6.5.
6.5 Place of performance. Unless you are a Czech tax resident, you confirm that you perform your promotional services from outside the territory of the Czech Republic.
7. Term and Termination
7.1 Term. These Program Terms apply from our approval of your application until terminated.
7.2 Ordinary termination. Either party may terminate participation at any time, with immediate effect, by written notice (email suffices). After ordinary termination, sales already made are honored: commissions that survive their 60-day hold are paid in the next payout cycle, and the $50 minimum is waived for the final payment.
7.3 Termination for cause. We may suspend or terminate your participation immediately if you breach these Program Terms. Commissions arising from fraudulent activity — including self-referrals, fake orders, cookie stuffing, or misleading promotion — are void, whether pending or paid, and paid amounts are repayable.
7.4 Record retention. We retain commission statements and payment records after termination for as long as Czech tax law requires.
8. Data Protection
We process your personal data (identity, address, tax identifiers, PayPal email, and Program activity) to operate the Program, pay commissions, and meet our accounting and tax obligations. PayPal acts as our payment processor for outgoing affiliate payments and receives the data necessary to execute them. Records are retained for the periods required by Czech tax law. For everything else — your rights, contact, and complaints — the Privacy Policy applies.
9. General
9.1 Independent contractor. You act as an independent contractor. Nothing in these Program Terms creates an employment, agency, partnership, or joint-venture relationship, and you may not make commitments on our behalf.
9.2 No exclusivity. You may promote other products, and we may work with other affiliates.
9.3 Liability. The Program is provided “as is”. To the extent permitted by law, our aggregate liability under these Program Terms is limited to the commissions paid to you in the 12 months preceding the claim.
9.4 Changes to these Program Terms. We may amend these Program Terms with at least 30 days’ notice by email or dashboard notification. Amendments apply prospectively. If you do not accept an amendment, your remedy is to terminate under Section 7.2 before it takes effect; continued participation constitutes acceptance.
9.5 Governing law. These Program Terms are governed by the laws of the Czech Republic. Disputes are subject to the jurisdiction of the Czech courts, without prejudice to mandatory consumer-protection rules that may apply to you.
9.6 Severability. If any provision is held invalid, the remainder stays in force.
