Tabule Theme presents this privacy policy to explain how we collect, use, and (under certain conditions) disclose personal information. Additionally, we outline the measures we take to ensure the security of the information you share with us, as well as the processes we follow to handle personal data.

At Tabule Theme, we are committed to maintaining the confidentiality and security of any personal information you share with us, honoring the trust of our users and any third parties interested in the services and/or products we offer.

If you are simply visiting our website, you are not required to share any information, as your status will remain anonymous unless you log in.

Basic information on data protection

In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 regarding the protection of natural persons with respect to the processing of personal data and the free movement of such data, effective from 25 May 2018 (hereinafter, GDPR), as well as the applicable Czech legislation, Tabule Theme outlines the conditions and procedures used for the processing of Users’ personal data.

  • Data Controller: “Tabule Theme”
  • Purpose: To deliver the products and services offered through the website, respond to requests, and maintain the commercial relationship between Tabule Theme and the user.
  • Legitimation: Performance of the contract, compliance with legal obligations, and, where applicable, the User’s consent.
  • Rights: Access, rectification, portability, and erasure of information, as well as other rights specified in this policy and applicable legislation.

2. General information

The personal data provided by Users to Tabule Theme will be processed by Tabule Theme as the Data Controller. This data is used to efficiently deliver the services or products offered by the website, respond to technical support requests, and meet the website’s objectives. Personal information will only be collected when Users or third parties interested in the services and/or products offered voluntarily provide it or when it is necessary to perform the contract between the User and Tabule Theme.

This policy applies solely to personal data collected by the website and the services described in it. It does not apply to information or data obtained by third parties on other websites, even if interconnected with Tabule Theme.

Tabule Theme does not conduct profiling and does not sell personal data. Data is shared only with the service providers listed in Section 8, for the purposes described there, and where required by law. Users retain full rights to access, rectify, limit, and delete their data, as well as exercise any other rights established by regulations, by contacting admin@tabuletheme.com.

3. Definitions

For the purposes of this policy, the terms below shall have the meanings indicated, regardless of whether they are written in plural, singular, uppercase, or lowercase. In case of confusion, the meanings will adhere to those stated herein or, alternatively, the applicable regulations:

  • Authorization: Refers to the prior, express, direct, and informed consent of the data subject to allow the processing of personal data.
  • Personal Data: Any information that is linked to or can be associated with one or more specific or identifiable individuals.
  • Public Data: Data that is not semi-private, private, or sensitive. Public data can be found in public records, official documents, gazettes, bulletins, and court rulings not subject to confidentiality.
  • Privacy Policy: A document, whether physical, electronic, or in another format, generated by the data controller and made available to the data subject. It informs the data subject about the existence of information processing policies, how to access them, and the characteristics of the intended data processing.
  • Data Controller: Tabule Theme, the entity responsible for decisions regarding the database and/or the processing of data for www.tabuletheme.com.
  • Website: www.tabuletheme.com.
  • Data Subject/User: The natural person whose personal data is being processed. This may include users, suppliers, or any third parties who provide personal data to Tabule Theme as part of a commercial or legal relationship.
  • Transfer: The act of sending personal data from the controller or processor, located in the Czech Republic, to a recipient (inside or outside the country) who is responsible for further processing the data.

4. Data Controller

As outlined above, Tabule Theme is the entity responsible for processing the personal data collected by the website. It applies the necessary security and protection measures to safeguard this information.

Users of the website declare and accept responsibility for processing their own data files and acknowledge that Tabule Theme will not be liable for non-compliance or penalties regarding data protection related to files managed independently by the user.

5. Collected data

This privacy policy applies to information collected during registration and user navigation within the website; through emails and support tickets exchanged between users and the website; through the license validation system described below; and via applications that offer direct access to the website without the mediation of a browser. However, it does not apply to information collected offline, by any other means, or by third parties (including advertising) linked to or from the website.

A. What personal data do we collect?

The types and amounts of personal data collected by Tabule Theme depend on the activity performed on the website:

Purchases of products offered:

  • Checkout form: First and last name, email address, billing address and country, company name (optional), order details (plan, amount, currency).
  • Payment data: Card and payment details are entered directly on a secure checkout page hosted by Stripe and are never collected, processed, or stored by Tabule Theme. See Section 8 for details on payment processing.

Account and technical support:

  • Account data: username, email address, and license information associated with the account.
  • Support tickets: the content of the ticket and any attachments (such as screenshots) the User chooses to upload. Users should avoid including personal data of third parties, or any data not necessary to resolve the issue, in tickets and attachments.

License validation system:

When Tabule Theme is activated on a website, the theme communicates with tabuletheme.com to validate the license and deliver updates. This communication includes the license key, the domain or URL of the website where the theme is activated, activation and deactivation events, and the technical data strictly necessary to validate the license and deliver updates.

Affiliate Program:

First and last name, email address, username, website URL, and the email address for payment processing.

The personal information mentioned above will be used for the specified activities and may also be utilized for:

  • Internal or external audit support.
  • Providing technical support.
  • Fulfilling legal requests from judicial or government agencies.
  • Sending transactional emails related to your purchase or account (order confirmations, license delivery, support responses) and, where the User has subscribed to them, informational communications, which can be unsubscribed from at any time.
  • Contacting users or suppliers.
  • Enhancing security and fraud prevention.
  • Any other purpose necessary for fulfilling the contract between the user and Tabule Theme.

Mandatory fields will be indicated on forms. Users who choose not to provide mandatory information will not be able to fully access website functionalities. To disable cookies, users should adjust their browser settings.

Users may also contact admin@tabuletheme.com to request access, correction, or deletion of any personal information provided. If Tabule Theme determines that such modifications would violate legal requirements or result in incorrect data, the website reserves the right to decline the requested changes.

Tabule Theme does not sell, license, transmit, or disclose personal data outside the website unless:

  • The user provides explicit authorization.
  • It is necessary to perform essential activities involving the service providers listed in Section 8.
  • It is required during a merger, acquisition, divestiture, or other restructuring process.

Tabule Theme reserves the right to outsource certain website functions to third parties. In such cases, Tabule Theme ensures that appropriate security measures are in place and prohibits the use of personal data for purposes other than those entrusted by Tabule Theme.

B. Special categories of data

Tabule Theme does not request or knowingly collect special categories of personal data as defined in Article 9 of the GDPR (such as data concerning health, religious beliefs, or political opinions). Users should not include such data in support tickets, attachments, or any other communication with Tabule Theme.

6. Purpose, legitimacy, category of data collected, retention period, and minors

6.1 Purpose

The purpose of processing personal data directly aligns with the objectives of the website, which include:

  • Marketing products and providing services for managing license keys to download and use a WordPress® theme called “Tabule.”
  • Offering service or technical support via the dashboard ticket system and email.
  • Hosting information about the theme.
  • Establishing an affiliate program to facilitate marketing.

6.2 Legitimacy

The processing of personal data is based on: the performance of the contract between the User and Tabule Theme (purchases, license management, support); compliance with legal obligations applicable to Tabule Theme; the User’s consent, where applicable (such as optional communications); and Tabule Theme’s legitimate interest in security and fraud prevention.

Where processing is based on consent, Users may withdraw their consent at any time by notifying the owner of the website.

6.3 Category of data collected

The data collected consists of identifying, contact, billing, and technical data as described in section 5.A. No special categories of personal data (Article 9 GDPR) are collected.

6.4 Retention period

Personal data is retained for as long as necessary for the purposes described in this policy and, thereafter, for the periods required by applicable law (such as tax and accounting obligations). Data that is no longer required for any of these purposes will be deleted, and Users may request deletion of their data at any time, subject to those legal retention obligations.

6.5 Minors

The website is not intended for individuals under eighteen (18) years of age. If a User is found to be underage, the relationship between the User and Tabule Theme will be considered void. The website owner reserves the right to take appropriate action and disclaims any liability resulting from a breach of this condition.

7. Automatic data collection

Tabule Theme informs Users that automatic data collection technologies are used to analyze browsing patterns, track actions, and enhance search functionality on the website. This data may include, but is not limited to, visits to the website, traffic logs, resources, communication data, IP address, operating system, and browser type.

In addition, the license validation system described in section 5.A automatically transmits license and activation data from websites where the theme is installed.

The website owner does not control tracking technologies employed by third parties. For more information, Users are encouraged to contact the relevant provider directly using the list provided by Tabule Theme.

8. Data processors and third-party services provided on the website

To ensure the proper operation of the website, Tabule Theme collaborates with service providers that perform data processing as necessary. These providers, known as Data Processors, comply with the obligations and standards required under applicable regulations. Tabule Theme utilizes providers both within and outside the EU/EEA, ensuring a high level of data protection.

Below is a list of these service providers:

  • Stripe, Inc. and its affiliated entities (Stripe©): Payment processing. Payments are completed on a secure checkout page hosted by Stripe; card data is provided by the User directly to Stripe and never reaches Tabule Theme.
  • Link (“Sold through Link, LLC”), through Stripe Managed Payments: For purchases with a billing country outside the Czech Republic, Link acts as merchant of record for the payment: it processes the payment, calculates and collects applicable taxes, issues the receipt, and may provide transaction-level support. Users can review their order at link.com.
  • Google LLC (Google Analytics©): Statistical services. See the website’s cookie policy at https://tabuletheme.com/cookie-policy/ for details.
  • Sendinblue SAS (Brevo©): Transactional email service.

Data collected by third parties

Depending on the service provided, third parties may collect the following data:

  • Cookies (Google Analytics): When using the site. For more details, review the website’s cookie policy at https://tabuletheme.com/cookie-policy/.
  • Payment processing (Stripe, and Link for purchases outside the Czech Republic): First and last name, email address, billing address and country, order amount, and the card or payment method data the User enters on the Stripe-hosted checkout page.
  • Affiliate program: First and last name, email address, username, web URL, and payment email address.

9. Principles we apply in the processing of personal data

In compliance with Chapter II of the GDPR, Tabule Theme adheres to the following principles in the processing of personal data collected through the website:

  • Data minimization: Only the minimum necessary data for each purpose (as specified in section 5.A) is collected and processed.
  • Legality and transparency: Data processing is conducted only when there is a legitimate basis, such as the performance of a contract, compliance with a legal obligation, or explicit consent.
  • Retention period limitation: Data is retained only for the periods described in section 6.4.
  • Confidentiality and integrity: The website owner implements the necessary security measures to ensure the confidentiality and protection of personal data.

10. Rights in the processing of personal data

In compliance with the GDPR, Users may exercise their rights by contacting Tabule Theme through the means provided on the website. These rights include:

  • Right of access: Request access to personal data (Article 15 of the GDPR).
  • Right to rectification: Request correction of inaccurate data (Article 16 of the GDPR).

Requests to exercise these rights will be addressed within one month, as required by the GDPR. If the data controller deems the request inappropriate, the User will be informed of the reasons within the same timeframe.

11. Data confidentiality and security

The data provided is stored on servers with firewalls and hosted in Europe. By using the website or providing data, the user consents to the transfer of their data to these servers.

In compliance with Article 32 of the GDPR, Tabule Theme informs users that technical and operational security measures are implemented to safeguard personal data. This includes the use of SSL security certificates on the website. Personal data is collected via HTTPS (HyperText Transfer Protocol Secure), which encrypts data transmission between the website server and the user.

While every effort is made to ensure the protection of personal data, the transmission of data over the internet is not entirely secure. The user acknowledges their responsibility for transmitting data and the risks posed by privacy settings or security measures on the website.

In the event of a data breach or potential personal data security violation, Tabule Theme will notify the Personal Data Protection Office and affected parties within a maximum of 72 hours, as required by Articles 33 and 34 of the GDPR.

12. Linking policy – hyperlinks

If individuals or legal entities create hyperlinks from their web pages to www.tabuletheme.com, the following conditions must be met:

The owner of the external website must obtain written authorization from Tabule Theme before:

  • Reproducing any related content, in whole or in part.
  • Establishing deep links, image links, or frames related to the website.
  • Using the trademark, trade name, logo, or any distinctive features of the website, except as indicated in the hyperlink.

No false, inaccurate, or misleading statements may be made about the website, its products, or services.

The use of a hyperlink does not imply any commercial relationship between the owner of the external web page and the owner of www.tabuletheme.com. Neither does it signify approval or endorsement of the services, products, content, or statements of the external page. Tabule Theme does not manage or control these aspects of external websites.

Tabule Theme assumes no liability for any direct, indirect, or subsidiary damages arising from access, use, quality, legality, reliability, or usefulness of content, information, communication, opinions, products, or services offered by external websites not managed by Tabule Theme.

13. Users and restricted access

The user is solely and exclusively responsible for safeguarding their password or access credentials. Tabule Theme is not liable for any damages or losses resulting from misuse, loss, or any other circumstance that leads to unauthorized access by third parties.

In any such case, the user must immediately notify Tabule Theme to resolve the issue.

14. Intellectual property and license

The intellectual property of the website and the licensing terms of Tabule Theme are governed by the Terms of Service, available at https://tabuletheme.com/terms-of-service/. Tabule Theme is licensed under the GNU General Public License v2 (or later), and the license key purchased by the User governs access to automatic updates, new versions, premium support, license activations, and certain theme features, as described in the Terms of Service.

15. Data transfer

Tabule Theme does not transfer user data except to the data processors mentioned in Section 8 for their respective purposes. Some of these providers are located in the United States; in such cases, transfers are carried out under appropriate safeguards, such as the EU–U.S. Data Privacy Framework or standard contractual clauses, as applicable. In compliance with Article 13.1(a) of the GDPR, Tabule Theme neither shares nor receives personal data beyond these purposes.

16. Acceptance and consent

By using the website, the user acknowledges and accepts this privacy policy and personal data protection policy. The user thereby provides legitimate consent to the processing of their data by Tabule Theme, according to the purposes and procedures outlined in this document.

17. Revocability

Users may revoke their consent at any time by notifying Tabule Theme. However, such revocation will not have retroactive effects.

18. Applicable legislation

This policy is governed and construed in accordance with the laws of the Czech Republic, without applying any principles of conflict of laws. If any provision of these terms and conditions is deemed unlawful, void, or unenforceable for any reason, it will not affect the validity or enforceability of the remaining provisions.

20. Changes to the privacy policy

Tabule Theme reserves the right to modify this privacy policy at its discretion or in response to changes in legislation, case law, or guidelines from the Personal Data Protection Office.

If changes are made, users will have five (5) days from the date of publication to notify the website owner if they do not accept the modifications. In such cases, the contractual relationship will be dissolved, and the user’s account will be disabled.

If the user does not raise any objections within this period, the updated privacy policy will be deemed accepted, and the contractual relationship will remain in force.
